Terms of sale

1. Purpose

These terms govern the sale of credits on OfficePixels, a service published by LVLUP. The service generates professional portraits with artificial intelligence, from a selfie. Any purchase implies acceptance of these terms.

2. Account and team

To buy credits, the customer creates an account and a team, and becomes its administrator. The customer then invites their team members, who each create their own account. Each user belongs to a single team. The customer undertakes to provide accurate information, in particular for invoicing.

3. Credits

• One credit generates the portraits of one person.
• A credit is used when a person's first generation starts.
• Each person receives 5 portraits, in portrait and square formats, and can generate a new set for free, once.
• Credits do not expire as long as the team account exists.
• If a generation fails for a technical reason, the credit is automatically returned.

4. Prices and payment

Prices are shown in euros, excluding VAT. Applicable VAT is calculated at checkout, based on the customer's country and status. Payment is made in a single instalment, through Stripe. Credits are added to the account as soon as the payment is confirmed. An invoice is issued for every purchase.

5. Right of withdrawal

A consumer customer is in principle entitled to a 14-day withdrawal period. Portraits are digital content supplied without a physical medium. Their generation starts at the customer's request, with the first selfie. By starting a generation, the consumer customer expressly agrees that performance begins before the end of the withdrawal period, and acknowledges losing their right of withdrawal for the credits used. Unused credits remain covered by the right of withdrawal for 14 days after the purchase.

6. Refund

A refund request is made by email to contact@lvlup.fr. An accepted refund covers the full amount paid. Unused credits are withdrawn, a credit note is issued, and the account is closed.

7. Obligations of the customer and users

• Each user only uploads photos of themselves.
• Each user must be 18 or older.
• Each team member gives their own consent before taking a selfie. The customer cannot consent on their behalf.
• Using the service to create misleading or defamatory images, or images that infringe the rights of third parties, is prohibited.

8. Use of the portraits

The customer and each team member may freely use the portraits showing them, for professional or personal purposes: website, social media, sales documents, internal tools. LVLUP never reuses the portraits, unless a separate written agreement is given.

9. Nature of the service and liability

Portraits are generated by artificial intelligence. They aim to represent the person faithfully, but a perfect likeness cannot be guaranteed. This is why each person can get a new set for free. LVLUP's liability is limited to the amount paid by the customer for the purchase concerned.

10. Retention and deletion

Selfies are deleted 7 days after the portraits are delivered. Portraits are deleted 90 days after delivery. Each user can delete their account at any time. Deletion becomes final 30 days after the request. During this period, the user can reactivate their account by logging in again. Details are in the privacy policy.

11. Mediation

In the event of a dispute, a consumer customer may use the consumer mediator free of charge: [mediator name and contact details].

12. Governing law

These terms are governed by French law. For a business customer, any dispute falls under the jurisdiction of the courts of Marseille.

13. Referral discount

A team created with a referral link gets a 10% discount on all its purchases. The referral cannot be added after the team is created.
